1. Acceptance of Terms

By using Cher Ami services — including this website, the client dashboard, or any campaign you launch through our platform — you agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

Cher Ami provides end-to-end door-to-door flyer marketing services in Contra Costa County, California, including campaign planning, flyer design, printing, branded packaging, physical delivery, and QR code scan tracking. Service availability is subject to geographic coverage, operational capacity, and compliance with applicable laws.

3. Campaign Minimums and Pricing

Campaigns require a minimum of 500 homes per delivery month. Pricing is set at the time of campaign approval and billed monthly. Volume discounts are applied at the end of a completed contract term only. Cher Ami reserves the right to adjust pricing for new campaigns with reasonable notice.

4. Client Responsibilities

Clients are responsible for ensuring that all flyer content submitted for printing complies with applicable laws and does not contain false, deceptive, or unlawful material. Cher Ami reserves the right to decline or cancel a campaign if submitted content violates these requirements.

5. No Guarantee of Results

Cher Ami guarantees physical delivery to the agreed number of homes with GPS and photo verification. We do not guarantee any specific number of QR scans, customer responses, sales conversions, or business outcomes resulting from a campaign. Marketing results depend on many factors outside our control.

6. Intellectual Property

Clients retain ownership of their business content, logos, and creative assets. By submitting content to Cher Ami, clients grant us a limited license to reproduce that content solely for the purpose of fulfilling the campaign. Cher Ami retains ownership of its platform, software, and proprietary delivery infrastructure.

7. Limitation of Liability

To the maximum extent permitted by law, Cher Ami is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim arising from a campaign is limited to the amount paid by the client for that specific campaign.

8. Governing Law

These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Contra Costa County, California.

9. Changes to Terms

We may update these terms from time to time. Continued use of Cher Ami services after changes are posted constitutes acceptance of the updated terms.
